Studio Bäsch GmbH (“Studio Bäsch,” “we,” “us,” or “our”) is a global company headquartered at Im Mediapark 5, 50670 Köln, Deutschland. These Terms of Service (“Agreement”) outline the terms and conditions by which we offer you access to our games, apps, products, websites, and other services (collectively, the “Services”), including Virtual Items (as defined in Section 3) and your Account (as defined in Section 1.3). This Agreement is a legally binding contract between you and Studio Bäsch. By accessing or using our Services, you agree to be bound by this Agreement.

If you do not agree to all of the terms in this Agreement, you are not permitted to use the Services, any Virtual Items, or create an Account.

1. Your Use of the Services

1.1 Age Restrictions and Legal Responsibility

You must be at least 18 years old (or the minimum legal age of adulthood in your jurisdiction) to enter into this Agreement. If you are under 18, a parent or legal guardian must review and agree to this Agreement on your behalf. Parents and guardians are responsible for supervising minors’ use of our Services.

1.2 Modifications to This Agreement

We reserve the right to update this Agreement at any time. If we make material changes, we will notify you before they take effect. If you do not agree with the updated terms, you must stop using the Services.

1.3 Your Account

Certain features of the Services require you to create an account (the “Account”). You are responsible for maintaining the security of your Account and must provide accurate information. You may not sell, transfer, or share your Account. We reserve the right to suspend or terminate Accounts that violate this Agreement.

1.4 Data Deletion Requests

If you wish to have your personal data deleted from our systems, you must send an email request to info@studiobasch.de that includes your IDFA (Identifier for Advertisers) number along with any additional information necessary to identify your account. We will process such requests in accordance with applicable data protection laws and our internal data retention policies. Please note that once your data is deleted, certain features of our Services may no longer function properly.

2. Limited License

2.1 Ownership and Intellectual Property

Studio Bäsch and its licensors own and retain all rights to the Services, including all software, content, trademarks, and intellectual property.

2.2 Personal, Non-Commercial Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for personal, non-commercial purposes.

2.3 Restrictions

You may not reverse-engineer, modify, distribute, or commercially exploit our Services without our express written permission. Use of our Services for unauthorized AI training, hacking, or cheating is strictly prohibited.

3. Virtual Items

Virtual Items (e.g., in-game currency, cosmetics, power-ups) are licensed, not sold. They have no real-world monetary value and cannot be transferred or exchanged outside the Services. We reserve the right to modify or remove Virtual Items at any time.

• The pricing, availability, and terms associated with Virtual Items are subject to change at any time without prior notice.

• All purchases of Virtual Items are final and subject to the policies of the digital storefront through which they were acquired.

• Virtual Items have no real-world cash value and may not be exchanged or redeemed for real-world currency.

4. Purchases, Billing, and Subscriptions

4.1 Digital Storefronts

Purchases made through third-party platforms (e.g., Apple App Store, Google Play, Steam) are subject to those platforms’ terms and conditions.

4.2 Subscriptions

Some Services may require a recurring subscription fee. Subscriptions will auto-renew unless canceled before the renewal date.

4.3 Subscription Auto-Renewal and Cancellation

All subscriptions are subject to automatic renewal. Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours prior to the renewal date through your account settings. Any unused portion of a free trial period will be forfeited upon purchase of a subscription. You acknowledge that charges for subscription renewals will be billed to your account and that you are responsible for any applicable fees.

5. User-Generated Content (UGC)

5.1 User Responsibilities

You are responsible for any content you create, upload, or distribute within our Services. You may not submit content that violates laws, infringes copyrights, or promotes harmful behavior.

5.2 Rights to UGC

By submitting UGC, you grant Studio Bäsch a non-exclusive, royalty-free, worldwide license to use, modify, and distribute your content.

6. User Rules and Code of Conduct

You agree not to:

• Engage in harassment, hate speech, or threats.

• Use cheats, hacks, or exploits.

• Share private information of others.

• Upload or distribute illegal content.

• Use the Services for unauthorized commercial purposes.

Violations of these rules may result in suspension or termination of your Account. Additionally, you agree not to:

• Attempt to access or disrupt Studio Bäsch’s information systems or engage in any activity that may compromise the cybersecurity or integrity of the Services.

• Misuse or improperly utilize Studio Bäsch’s trademarks, logos, or other intellectual property in any communications, advertisements, or unauthorized commercial activities.

• Use the Services to facilitate or engage in cyberattacks, hacking, or the distribution of malicious software.

7. Content Reporting and Takedown Requests

If you believe any content within our Services violates this Agreement, you may report it through our in-game reporting tools or Customer Support.

8. Updates and Features

We may update or modify our Services at any time. Some features may be discontinued, and we are not obligated to maintain compatibility with older versions.

9. Your Responsibilities to Us

You agree to indemnify and hold harmless Studio Bäsch from any claims arising from your violation of this Agreement.

10. Termination

You may delete your Account at any time. We reserve the right to terminate your Account for violations of this Agreement or for any other lawful reason.

11. Photosensitive Seizure Warning

Some users may experience seizures due to flashing lights in video games. If you have a history of epilepsy, consult a doctor before using our Services.

12. Miscellaneous

12.1 Export Laws

You must comply with all applicable export laws and restrictions.

12.2 Device Security and Connectivity

You are solely responsible for maintaining the security of your device and ensuring an active internet connection when using our Services. Studio Bäsch is not liable for any data charges, including roaming fees, that may be incurred when accessing our Services over mobile networks. Additionally, modifying your device’s security settings (such as jailbreaking or rooting) may compromise the proper functioning of the Services and is strongly discouraged.

12.3 Device Functionality

It is your responsibility to ensure that your device is properly maintained and sufficiently charged to use the Services. Studio Bäsch shall not be liable for any service interruptions or malfunctions caused by issues such as depleted battery power or hardware failure.

14. Governing Law, Disputes, and Liability

14.1 Jurisdiction

This Agreement and all disputes relating to it shall be construed under and governed by the laws of Germany, without regard to any conflict of law principles. All disputes or claims arising out of or in connection with this Agreement shall be finally settled by the courts located in Cologne, Germany.

14.2 Limitation of Liability

To the fullest extent permitted by law, Studio Bäsch is not liable for indirect, incidental, or consequential damages. In no event shall Studio Bäsch’s total liability to you for any claims arising under or related to this Agreement exceed the total amount you have paid to Studio Bäsch in the six (6) months immediately preceding the date on which the claim arose. If no payment has been made during such period, your sole remedy is to discontinue using the Services.

15. Notice

Studio Bäsch may notify users via postings on its Website or within the Services, and via the email address you have provided. All notices required from you to Studio Bäsch as per this Agreement shall be sent to info@studiobasch.de.

16. Warranty Disclaimer

THE SERVICES ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. STUDIO BÄSCH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR DOES IT GUARANTEE THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
